This webinar will discuss the counter to Plaintiffs’ raising the argument that, under what is really a novel interpretation of Federal law, that motor carrier – and namely the motor carrier’s driver in an accident scenario – is the statutory employee of the involved freight broker. The argument has gotten traction in certain trial courts around the country and both defense attorneys, industry members, and (moreover) judges need to be educated on what is really required under Federal law and motor carrier / transportation regulations. Specifically, a trial court that would agree with the Plaintiff on this argument would have to ignore 60+ years of precedent under the Federal leasing statute and its associated regulations, as well as the plain language of the regulations themselves. These regulations and precedent were developed largely under litigation on cargo claims and this webinar will cover this evolution and how critical it is to countering statutory employment arguments made by plaintiffs before judges unaware of this body of law – how these arguments are likely to be pervasive of the U.S. Supreme Court’s May 2026 in Montgomery v.
