In some cases, the vehicles are booted with the threat of towing is the “ticket” if not paid immediately. These documents are not issued by law enforcement or municipalities, yet they are often styled to appear enforceable and urgent. The practice is not isolated. Similar private parking and ticketing practices involving commercial vehicles are already the subject of civil litigation in federal court, including civil claims brought under federal racketeering statutes (RICO). Those allegations center on coordinated private enforcement and collection activity directed at motor carriers. The severity of the issue has resulted in some states passing laws to prohibit predatory practices.
